Bikenavi subscription and terms of use

Welcome to Bikenavi. By using the Bikenavi application for route planning and navigation, you agree to these Terms of Use and Privacy Policy. Please read and familiarise yourself with them carefully before using the application.

Using the app

Access to the free parts of the service

When a user registers for the Bikenavi application, they receive a perpetual licence to use the free parts of the service. Bikenavi may, at any time, terminate the licence to use the free version, and is not obliged to provide support or maintenance services for the use of the free parts.

Access to the paid parts of the service

When a user subscribes to the Bikenavi service, they are granted access (a licence) for a specified subscription period.

Ordering

Only an adult of legal age can place an order. The Bikenavi mobile application can be downloaded from the app store (Google Play and Apple App Store). Downloading the app and placing an order require the user to also accept the terms of use and privacy policies of these app stores.

We offer various subscription options that renew automatically. You can cancel your subscription at any time, but refunds for payments are generally only issued when required by law.

The purchased subscription is for your personal use only; you may not share it with others or use it for commercial purposes without permission.

Bikenavilla has the right to change the terms and conditions of the product, service prices, and billing principles at its own discretion, by notifying the customer in a manner it deems appropriate, well in advance.

Changes and cancellations

We may modify or discontinue parts of our services, and we aim to provide advance notice of any such changes.

No guarantees

We provide Bikenavi on an ”as is” and ”as available” basis. We do not guarantee that the service will be complete or error-free, nor do we guarantee that the maps and information will be entirely accurate or up to date.

Disclaimer and liability

You are responsible for using Bikenavi, including complying with laws and respecting other people and the environment.

We are not responsible for any direct, indirect, incidental, or consequential damages or losses arising from the content of this website or application, or from your use of or reliance on its content.

We do not pay damages or other compensation for losses, injuries, fines, or other harm caused by the use of this website or application, or reliance on its content, or other websites linked from this website.

We are not liable for data or software stored on digital media, as the risk lies with the customer. Back-ups are the responsibility of the buyer.

We are not responsible for routes designed, created, or shared by the user/customer. We are not responsible for routes travelled by the user.

Legal matters

The laws of our own jurisdiction shall apply to our terms of use. Any disputes shall be settled in that jurisdiction.

Information security and data protection

Bikenavi complies with applicable data protection and privacy laws and regulations. You can find more information in our privacy policy.

Intellectual property rights

All content within the app, such as text, graphics, logos, icons, and images, is owned by us or licensed to us and protected by intellectual property rights. You may not use, copy, modify, or distribute any content without our written consent.

Apple App Store Compliance

The provisions of this section strictly apply to users who download and use the Bikenavi app on Apple iOS devices via the Apple App Store:

Parties to the Agreement (Acknowledgement): You and Better Ride Oy acknowledge that this End User License Agreement (EULA) is concluded solely between you and Better Ride Oy, not with Apple Inc. Better Ride Oy, not Apple, is solely responsible for the Bikenavi application and its content. These terms do not conflict with the Apple Media Services Terms of Use.
Scope of License The licence granted for the Bikenavi app is a non-transferable licence to use the app on all Apple-branded devices owned or controlled by you as permitted by the Apple Media Services Terms and Conditions. However, the app may also be used by other accounts associated with the purchaser through Family Sharing or Volume Purchase.
Maintenance and Support Better Ride Oy is solely responsible for providing maintenance and support services for the Bikenavi application as required by these terms or applicable law. You acknowledge that Apple has no obligation whatsoever to provide maintenance or support services for the application.
Takuu ja hyvitykset Better Ride Oy is solely responsible for any express or statutory warranties to the extent they have not been validly disclaimed. If the App fails to meet any warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the fullest extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages or costs relating to failure to meet any warranty will be the sole responsibility of Better Ride Oy.
Product Claims You acknowledge that Better Ride Oy, not Apple, is responsible for addressing any claims you or any third party may have relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection laws or similar legislation.
Immateriaalioikeudet (Intellectual Property Rights): You acknowledge that, in the event of a third party's claim that the Bikenavi app or your possession and/or use of the Bikenavi app infringes that third party's intellectual property rights, Better Ride Oy, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such intellectual property infringement claim.
Legal Compliance You represent and warrant that (i) you are not resident in a country that is subject to a U.S. government embargo or has been designated by the U.S. government as a ”state sponsor of terrorism”; and (ii) you are not on any list of prohibited or restricted parties of the U.S. government.
Third Party Terms of Agreement You must comply with applicable third-party terms and conditions when using the Bikenavi application (for example, you must not violate your mobile operator's data service agreement or your internet service agreement when using the application).
Third-party beneficiary You and Better Ride Oy acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and that upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
